1. ELIGIBILITY AND SITE USE

• Age Requirement: You must be at least 18 years old to use this Site. If you are between 13 and 18, you represent that you possess the explicit permission and supervision of a parent or legal guardian who agrees to be bound by these Terms.

• Lawful Use: You agree to use this Site strictly for lawful purposes. Prohibited activities include hacking, disrupting site performance, introducing malware, or using automated buying software (bots).

 

2. USER ACCOUNTS AND SECURITY

• Account Responsibility: If you register an account, you are solely responsible for maintaining the confidentiality of your username and password. You assume full liability for all financial transactions and activities that occur under your credentials.

• Right to Terminate: We reserve the right to suspend or terminate accounts, refuse service, or cancel pending orders at our sole discretion, without prior notice, if fraudulent or unauthorized activity is suspected.

 

3. THIRD-PARTY PLATFORM DISCLAIMER (WIX)

SHIPLEYSTCG.COM is hosted on the Wix.com e-commerce platform. Wix provides us with the online platform that allows us to sell our products to you. By using this Site, you acknowledge and agree that SHIPLEYSTCG.COM has no control over, and assumes no responsibility or liability for:

• Platform Downtime: Any temporary website outages, server downtimes, or accessibility issues caused by Wix infrastructure.

• Technical Glitches: Malfunctions, software errors, or checkout glitches native to the Wix system that may impact order placement or processing.

• Data Security: Data breaches, security incidents, or unauthorized access to the extent that it occurs natively within Wix’s stored data or cloud hosting environments.

 

All transactions and platform uses are subject to Wix’s native technical limitations, and you agree to hold SHIPLEYSTCG.COM harmless for any indirect damages resulting from platform-wide failures.

 

4. ORDERS, MARKET VOLATILITY, AND PRICING

• Market Fluctuation: The Trading Card Game (TCG) market is highly volatile. Once an order is successfully placed, the purchase price is locked. We do not offer refunds, retroactive discounts, or price-matching if a product’s market value drops after your purchase. Conversely, you are not responsible for paying more if the value spikes.

• Systemic and Pricing Errors: If an item is listed at an incorrect price due to a system glitch, data feed error, or typographical mistake, we reserve the right to cancel any orders placed for that item. We will issue a full refund and are under no obligation to fulfill orders at the erroneous price.

• Order Limits & Anti-Scalping: To ensure fair access for collectors and players, we reserve the right to limit product quantities per person, per household, or per order. This includes orders using the same account, credit card, billing address, or shipping address.

• Right of Refusal: We reserve the absolute right to cancel, limit, or refund any order that, in our sole judgment, appears to be placed by dealers, resellers, distributors, or automated botting software.

 

5. PRE-ORDERS AND DISTRIBUTOR ALLOCATIONS

• Allocation Reductions: Manufacturing and distribution schedules are subject to change. If our incoming distributor inventory is reduced or cut unexpectedly, we reserve the right to fulfill pre-orders on a first-come, first-served basis, reduce order quantities, or cancel and fully refund your pre-order.

• Pre-Order Cancellations: All approved pre-order cancellations are subject to a 3% cancellation fee to cover non-refundable merchant payment processing fees.

 

6. CARD CONDITION AND GRADING DISCLAIMER

• Subjective Assessment: Card conditioning is inherently subjective. All individual single cards are evaluated and categorized based on our internal grading standards, which align closely with industry-standard guidelines.

• Third-Party Grading: We do not guarantee that a card sold by us as "Near Mint" or any other condition designation will receive a specific numerical grade (e.g., PSA 10, BGS 9.5, CGC 10) if submitted to a third-party grading company. All sales are based solely on our listed condition at the time of sale.

 

7. RETURN, REFUND, AND FRAUD POLICY

• All Sales Final: To safeguard our customer ecosystem against product tampering (such as card swapping, pack weighing, box mapping, or resealing), all sales are strictly final. This all-sales-final policy applies to individual single cards, individual booster packs, and all sealed products (including, but not limited to, factory-sealed booster boxes, elite trainer boxes, blister packs, tins, and case quantities), whether opened or unopened. No returns, exchanges, or refunds will be issued once an item has shipped.

• Chargeback Abuse: Fraudulent credit card chargebacks will not be tolerated. Initiating a groundless chargeback for a successfully delivered order will result in a permanent ban from our Site, immediate cancellation of all pending orders, and referral to a collections agency or legal counsel.

 

8. SHIPPING, RISK OF LOSS, AND CARRIER RESPONSIBILITY

• Risk of Loss: All physical items are shipped pursuant to a standard shipment contract. The risk of loss, title, and ownership of the goods transfer directly to you the moment we hand the package over to the designated shipping carrier (USPS, UPS, FedEx, or DHL).

• Carrier Delays and Theft: SHIPLEYSTCG.COM is explicitly not liable for packages delayed by weather, damaged in transit, or stolen after being marked as "Delivered" by the shipping carrier.

 

9. MARKETING COMMUNICATIONS AND CONSENT

• Email Marketing: By providing your email address during checkout, registration, or via opt-in forms, you consent to receive store updates, promotions, and newsletters. You may opt out at any time via the "Unsubscribe" link at the bottom of any email.

• SMS Marketing: By opting into text communications, you consent to receive promotional texts regarding events, restocks, or cart abandonments. Standard message and data rates applied by your mobile provider may apply. You may opt out at any time by replying "STOP". SHIPLEYSTCG.COM is not liable for charges incurred from your mobile carrier.

 

10. INTELLECTUAL PROPERTY AND BRAND COMPLIANCE

• Proprietary Assets: All custom content displayed on SHIPLEYSTCG.COM—including brand logos, original text, custom imagery, website layouts, and graphics—is the exclusive property of SHIPLEYSTCG.COM. Reproduction or redistribution without explicit written authorization is strictly prohibited.

• Trademark Disclaimer: SHIPLEYSTCG.COM operates as an independent retail storefront. All trading card game names, logos, character titles, and official product imagery (including but not limited to Pokémon, Magic: The Gathering, and Yu-Gi-Oh!) are the exclusive property of their respective trademark and copyright holders (e.g., Nintendo, Wizards of the Coast, KONAMI). Our use of these trademarks is solely for identification and retail product descriptions.

 

11. LIMITATION OF LIABILITY

• Exclusion of Damages: To the maximum extent permitted by applicable law, SHIPLEYSTCG.COM, its owners, directors, officers, and employees shall not be held liable for any indirect, incidental, punitive, special, or consequential damages resulting from your use of the website or products purchased.

• Maximum Financial Cap: Our total cumulative financial liability to you for any claim arising out of a retail transaction shall never exceed the exact purchase price paid by you for that specific order.

 

12. GOVERNING LAW AND JURISDICTION

• These Terms of Service and any separate agreements whereby we provide you services shall be exclusively governed by, construed, and enforced in accordance with the laws of the State of Texas, without regard to conflict of law provisions. Any and all legal proceedings, lawsuits, or disputes arising out of or relating to these Terms or your use of the Site must be initiated and maintained exclusively within the state or federal courts located in Williamson County, Texas, and you hereby consent to the personal jurisdiction of such courts.

 

13. MODIFICATIONS AND SEVERABILITY

• We reserve the right to update, modify, or replace any section of these Terms of Service at any time without direct individual notification. Revisions take effect immediately upon posting to the website. If any provision of these Terms is deemed unlawful or unenforceable, that specific provision shall be severable and will not affect the validity of the remaining terms.
